E-bike e-scooter accident attorney
Electric bikes and scooters occupy an unsettled space in the law. Whether a particular device counts as a bicycle, a motor vehicle or something else varies by state and by the device’s own specifications, and that classification determines where it may be ridden, what insurance applies and how a claim is analyzed. Law Offices Of SRIS, P.C. handles motor vehicle claims in Virginia, Maryland, the District of Columbia, New Jersey and New York.

ToggleEstablishing the device and what happened
The device specifications matter as evidence: motor power, top assisted speed and whether propulsion requires pedalling determine the classification in most state frameworks. Preserve the device unrepaired. Where it is a rental, the operator holds trip data — route, speed, duration — and that record should be requested promptly. App terms of service, which the rider accepted, frequently contain provisions affecting how disputes proceed. Video and scene evidence apply as in any collision.
Why classification decides the analysis
Classification determines where the device could lawfully be ridden, which bears directly on fault — particularly in contributory negligence jurisdictions where riding somewhere prohibited could defeat the claim entirely. It also determines whether motor vehicle insurance provisions apply, including uninsured and underinsured motorist coverage, and whether the rider’s own auto policy responds at all. This should be resolved before anything else.
The injury pattern
Standing scooters in particular produce a characteriztic pattern: the small wheels and standing posture mean a surface irregularity can pitch the rider forward with no opportunity to recover, so head and facial injury and upper limb fractures predominate. Helmet use is lower than among cyclists. Injuries are frequently more severe than the low speeds suggest, and head injury should be assessed even where the rider walked away.
How these claims are contested
On classification and on whether the rider was somewhere they were entitled to be. On the rider’s conduct generally, in contributory jurisdictions with potentially decisive effect. On the rental operator’s side, through the terms of service the rider accepted, which may include liability provisions whose enforceability varies by jurisdiction. And where a device defect is alleged, through the usual product defenses.
Acting properly
Determine the classification of the specific device under the relevant state framework — this comes first. Preserve the device. Request rental trip data promptly and obtain a copy of the terms accepted. Where a mechanical failure is suspected, preserve everything and have the device examined before it is returned to the operator. Secure video. And establish the rider’s position and conduct affirmatively, because in a contributory jurisdiction that is where these claims are decided.
Available insurance coverage
What can be recovered is limited by what coverage exists. The at-fault party’s policy is the starting point, but it is frequently not the only source: the injured person’s own uninsured and underinsured motorist coverage, household policies, employer coverage where a vehicle was used for work, umbrella and excess layers, and the coverage of any additional responsible party can all apply. Underinsured coverage typically requires notice and consent before any settlement with the at-fault party — settling first can forfeit it. Identifying every available layer is early work, not closing work.
How damages are categorised and proven
Damages are not a single number that gets negotiated. They are separate categories, each proven by different evidence. Past medical expense is proven by billing records and the reasonableness of the charges. Future medical expense requires a physician’s opinion that the care is reasonably certain to be needed. Lost income is proven by employment and tax records; lost earning capacity is a different and larger question requiring vocational and economic analysis. Non-economic loss — pain, limitation, and the effect on daily life — is proven through the medical record and through testimony from people who can describe specific changes rather than general decline. No one can responsibly tell you what a case is worth before that evidence exists, and any figure offered at the outset is a guess.
Filing deadlines
Every injury claim is governed by a statute of limitations, and the periods differ by state and by claim type. For personal injury actions the period is two years in Virginia under Va. Code § 8.01-243(A), accruing at the date of injury; three years in Maryland under Md. Code, Cts. & Jud. Proc. § 5-101; three years in the District of Columbia under D.C. Code § 12-301(8); two years in New Jersey under N.J.S.A. 2A:14-2; and three years in New York under N.Y. C.P.L.R. § 214(5). These are general periods. Discovery rules, tolling for minors and incapacity, claims against government entities — the District imposes a six-month notice-of-claim requirement for claims against the District government — and claim-specific statutes can shorten or extend them. Do not rely on a general period for your own case; have the deadline confirmed on your facts.
Frequently Asked Questions
Is an e-bike treated as a bicycle or a motor vehicle?
It depends on the state and on the device’s specifications — motor power, top assisted speed and whether pedalling is required. Many states use a class system that determines where each type may be ridden. The classification governs the legal analysis, so it should be established at the outset.
Why does classification matter for my claim?
Because it determines where you could lawfully ride, which bears on fault — decisive in Virginia, Maryland and the District, where contributory negligence can bar recovery entirely. It also determines whether motor vehicle insurance provisions, including uninsured motorist coverage, apply to your situation.
I was riding a rented scooter. Does the rental agreement affect my claim?
It may. Terms of service accepted through the app frequently contain provisions affecting how disputes are resolved. Their enforceability varies by jurisdiction and by the specific term. Obtain a copy of the version you accepted, because operators update terms and the current version may not be the one that applies.
What if the scooter malfunctioned?
Preserve it and do not return it to the operator before it has been examined. Brake failure, throttle malfunction, wheel or stem failure and battery incidents are recognized issues. A product claim may exist against the manufacturer or the operator, but it depends on examining the actual device.
Why are scooter injuries so severe at low speeds?
Because of the standing posture and small wheels. A pothole, kerb edge or tram line can stop the wheel abruptly and pitch the rider forward with no chance to recover, head first. That mechanism produces head and facial injury and upper limb fractures at speeds that sound harmless.
Does my auto insurance cover me?
Possibly, depending on the policy terms and on how the device is classified in your state. Uninsured and underinsured motorist coverage sometimes responds to injuries sustained on these devices. It is worth checking your policy and any household policy rather than assuming it does not apply.
Can I claim if I hit a pothole?
Potentially, against the entity responsible for maintaining the surface — but claims against public entities carry notice requirements far shorter than the ordinary limitations period. Photograph the defect immediately, because road repairs remove the evidence, and have the notice deadline determined at once.
How long do I have to bring a claim?
Two years in Virginia and New Jersey, three years in Maryland, the District of Columbia and New York for personal injury actions, with much shorter notice periods where a public entity is involved. Rental trip data and app terms should be secured well before that.
